Sponsor Spouse From Outside Canada: The Outland Process Explained
If your spouse or partner is living abroad and you want to bring them to Canada as a permanent resident, you'll be filing what IRCC calls an outland sponsorship application — even if they're currently visiting Canada. This is the traditional route for spousal sponsorship, and for many couples, it's the more strategic choice.

What "Outland" Actually Means
Outland sponsorship applies when the sponsored spouse's application is processed based on where they normally live outside Canada, not where they happen to be at the time of filing. So even if your spouse enters Canada on a visitor visa while the application is in process, the file is still assessed as outland as long as that's how it was filed. Permanent residence is granted before they land in Canada, and they become a PR the moment they arrive with their visa or Confirmation of Permanent Residence.
Why Couples Choose Outland Over Inland
The two streams exist for the same program but carry real differences:
· Appeal rights. If an outland application is refused, you can appeal to the Immigration Appeal Division (IAD). This is a full tribunal hearing, you can submit new evidence, call witnesses, and have the case reviewed fresh. Inland refusals, by contrast, can only be challenged through judicial review at the Federal Court, which is a much narrower process: the court only checks whether the original officer made a legal error, based on the same record that was already before them.
· No dependence on temporary status. Because the sponsored spouse doesn't need to hold valid status in Canada during processing, outland sponsorship works regardless of visa history, prior refusals, or overstays abroad.
· Processing speed. Outland files have generally moved somewhat faster than inland ones in recent processing cycles, though this shifts month to month based on IRCC's inventory.
The trade-off is that there's no automatic work permit tied to the outland stream, your spouse won't be able to work in Canada while the application is processing unless they separately qualify for a temporary work or study permit.
Eligibility
The same core relationship categories apply:
· Spouse — legally married, valid both where the marriage took place and under Canadian law
· Common-law partner — continuous cohabitation for at least 12 months
· Conjugal partner — a committed relationship of 12+ months, with cohabitation prevented by an immigration or legal barrier
As the sponsor, you need to be a Canadian citizen or permanent resident, at least 18, and able to demonstrate the relationship is genuine. There's no minimum income requirement for spousal sponsorship, the relationship is the main point of review.
How the Outland Application Works
1. Prepare the application together. Both the sponsor and sponsored person complete their respective forms and gather documents.
2. Submit online through your IRCC secure account (paper is available in limited cases).
3. Get your Acknowledgment of Receipt (AOR) once IRCC confirms your package is complete.
4. Biometrics and medical exam. The sponsored person (and any dependants) will need to complete biometrics and an Immigration Medical Exam through an IRCC-approved panel physician.
5. Background and admissibility checks. IRCC reviews police certificates and runs security/criminal admissibility checks.
6. Interview (if requested). Not every couple is interviewed, but if the relationship evidence raises questions, IRCC may schedule one at the visa office.
7. Decision. If approved, your spouse receives either a permanent resident visa (most countries) or a Confirmation of Permanent Residence, which they use to enter Canada and finalize their status at the port of entry.

· Identity documents for both sponsor and sponsored person (passports, birth certificates)
· Marriage certificate or proof of common-law/conjugal relationship
· Ongoing relationship evidence — photos, communication history, joint finances, travel records, letters of support
· Sponsor's proof of Canadian citizenship or PR status
· Police certificates from every country the sponsored person has lived in for 6+ months since age 18
· Immigration Medical Exam results
· Any relevant legal documents (divorce certificates, custody arrangements)

The Right of Permanent Residence Fee is refundable if the application is refused or withdrawn before finalization. Always confirm current amounts on IRCC's official fee list, since fees can change.
Processing Times
Outland spousal sponsorship has generally been processing in the range of 10 to 14 months for most applications heading into late 2026, though this shifts monthly based on IRCC's inventory and is affected by the country you're applying from, some visa offices move faster than others. If you live outside Canada and the U.S. and are applying through a Canadian embassy, high commission, or consulate, IRCC advises adding 3 to 4 months to account for mail time if you're not submitting online. Always check IRCC's live processing time tool for the estimate specific to your visa office.
A Note on Visiting Canada During Processing
Your spouse can still apply for a visitor visa to come to Canada while their outland sponsorship is in process, as long as they meet the standard visitor visa requirements and can satisfy the officer they'll leave at the end of their stay if the sponsorship isn't yet approved. This is a separate application from the sponsorship itself, and approval isn't guaranteed just because a sponsorship is underway.
